ONLINE PURCHASE AGREEMENT
World Wide Arts Resources, Corp. an Ohio Corporation, hereinafter known as WWAR,
is in the business of providing Internet services to Artist Customers to expose those Artist's creativity on a world wide basis,
and facilitate the opportunity for those Artists to market their creative project to a world wide customer base.
WWAR and the Customer (Artist's Buyer) agree as follows:
- WWAR will act as an intermediary for the sale of artwork (over $100), between the Artist and the Artist's Buyer. All artworks are subject to availability. Any works below $100 shall be handled by the artist and the Artist's buyer. absolutearts.com shall not be involved in sales under $100.
- Any sale shall take place between the artist and the Buyer.
All sales shall be denominated in United States Dollars or Euros for Bank Transfers to WWAR's European bank accounts.
- No minors may purchase art through WWAR.
- The agreed purchase price of the art, including shipping and insurance, shall be paid in full and deposited in full to WWAR, prior to shipping.
- WWAR will accept payment from the Buyer in United States currency,
or EURO (for NON-USA originating bank transfers), or by appropriate charge/ debit
(Visa, Mastercard, American Express, and Discovery), in an equivalent amount to the U.S. Dollar sales figure.
- Artwork cost, shipping costs, including appropriate insurance all custom duties and applicable taxes, is and remains the responsibility of the Buyer. If the Buyer agrees to pay a higher cost for shipping than the price of the artwork, the artwork cannot be returned and that sale is considered final.
- The Buyer shall be responsible for all applicable copyright laws.
- Upon receipt of the artwork by the Buyer, the artist's Buyer shall have three (3) business days to reject the work.
All sales are between the Artist and the Buyer and shall be final, except as otherwise provided herein. Commissioned works cannot be returned and all commissioned work sales are final.
- If the artwork is rejected by the Buyer, the Buyer must ship the artwork back to the artist within three (3) business days - WWAR will hold any payment by the Buyer until notified by the Artist that the artwork has been received back in good original condition, by the Artist. Buyer pays for duties, customs applicable taxes including costs for shipping work back to the artist. If the Buyer returns more than one artwork within a 30 day period, Buyer is responsible for all shipping costs, duties, customs on all second plus artworks (this includes shipping from the artist to the Buyer and from the Buyer back to the artist).
Alternatively, where WWAR is notified by the Buyer of delivery as evidenced by a signed return receipt,
e-mail or tracking notification, and the Artist fails to confirm receipt, in answer to a WWAR notification,
for a period of at least thirty (30) days, following receipt or constructive receipt,
as outlined herein, WWAR will return the Buyer's payment.

If the artwork is damaged by the Buyer, the Buyer or Buyer's insurance shall take full responsibility. The Buyer cannot return the work once damaged by the Buyer and all damaged work sales are final. In case of dispute of who damaged the artwork communications and settlements shall be between the Buyer, Artist and WWAR. WWAR and the artist shall not be liable in case the Buyer damages the artwork.
- In the event any payment has stopped for any reason, WWAR shall not be held responsible for said stop payment,
by either the artist or the artist Buyer. Any remedies for WWAR against either the Buyer or the seller shall be preserved however, any action for payment or recovery of artwork as and between the Buyer and the seller shall remain the sole responsibility of said Buyer or said artist seller.
- WWAR reserves the right to refuse any sale for any reason. WWAR will not process credit cards or sales it deems fraudulent. WWAR will not ship to any destination it deems questionable or fraudulent. WWAR does not ship to Post Office Boxes. Email addresses or any address must be verified before WWAR will ship any artwork. Anonymous email addresses will not be accepted with credit card purchases, nor will WWAR accept third party credit cards or transfers without prior approval.
In requesting that WWAR undertake this service for the Artist Buyer, and the Artist, the Artist Buyer agrees as follows:
The Artist Buyer understands and agrees that WWAR may reject or refuse to undertake any transaction or request to act as outlined herein, for any reason. Upon accepting a transaction or request, the full extent of WWAR's responsibility is and shall be limited to the express duties as set out herein.
The Artist Buyer agrees that all information provided is within the providence of the Artist, and WWAR makes no warranties as to originality, copyright infringement.
WWAR may cancel this contract at any time.
The parties hereto agree, that all rights and duties under this contract shall be governed by the laws of the State of Ohio,
this transaction bearing a reasonable relation to said state.
The parties hereto agree, that in the event of any dispute arising from this contract,
the dispute shall be submitted to arbitration, in Franklin County, Ohio, USA,
within one (1) year from the date of the event from which the dispute arises, as outlined by the laws of the State of Ohio,
and any action after said time is herein and hereby precluded.
Arbitration as outlined herein, shall be the exclusive remedy of either party to the dispute,
and the results thereof shall be binding on all parties.
WWAR's liability is any case, shall be limited by this contract, and shall in no case,
be greater than one hundred percent (100%) of the purchase price.
